1. Nature of the service
NightFN (nightfn.com) operates as an online marketplace where independent third-party sellers list digital gaming accounts for sale to buyers worldwide. NightFN itself does not own, create, or directly sell the listings published on the platform — each listing is owned and managed by the seller who created it. NightFN facilitates discovery, communication, payments, and delivery between the parties.
All products offered are digital. No physical items are shipped.
2. Marketplace roles
- Buyers use NightFN to browse listings, contact sellers, and complete purchases through the platform's secured checkout.
- Sellers are independent users who list their own digital products, set their own prices, and are responsible for the accuracy of their listings and the delivery of what they sell.
- NightFN acts as an intermediary that provides the marketplace, payment processing, and dispute mediation tools — but is not the seller of the listed products.
3. Buyer responsibilities
By placing an order on NightFN, you agree to:
- Provide accurate and complete information during checkout.
- Review the listing details carefully before purchasing.
- Follow all login, security, and account-handling instructions provided by the seller.
- Secure the delivered account immediately after delivery (change passwords, update recovery email, enable 2FA).
Once a product is delivered, securing it is the buyer's responsibility.
4. Seller responsibilities
Sellers using NightFN agree to:
- List only products they legally own and have the right to sell.
- Provide truthful, accurate, and up-to-date information in listings (cosmetics, rarity, status, region, etc.).
- Deliver the exact product described, in the condition shown, within a reasonable time.
- Not interfere with the account after delivery (no recovery attempts, password changes, or chargebacks against buyers).
- Respond to buyer inquiries and support tickets in a timely and respectful manner.
By uploading images, screenshots, descriptions, or other content to NightFN, the seller represents and warrants that they have the necessary rights to submit and display that content and that such content does not unlawfully infringe any third-party intellectual property rights. The seller grants NightFN a limited, non-exclusive license to host, display, and technically process such content solely for the purpose of operating and displaying the relevant marketplace listing.
Sellers who violate these rules may have their listings removed, payouts withheld, or accounts permanently suspended.
5. Payments & delivery
All purchases on NightFN must be completed through the platform's official checkout. Off-platform payments are not protected by NightFN and are strongly discouraged.
Once payment is confirmed, the seller (or NightFN on the seller's behalf, where automated delivery is enabled) will deliver the product through the platform. After delivery has been completed, ownership and responsibility for the product transfer from the seller to the buyer.
6. Disputes & refunds
If an issue arises with an order, buyers and sellers must first attempt to resolve it through NightFN's built-in support and ticket system. NightFN may step in to mediate disputes between the parties.
Refunds and replacements are governed by the Refund Policy, which forms an integral part of these Terms.
Buyers agree not to initiate payment disputes or chargebacks before contacting NightFN support. Abuse of dispute systems, fraudulent claims, or false reports may result in service restriction or permanent account limitation for either party.
7. Communication between users
All buyer–seller communication should take place through NightFN's messaging system, so that records are available in case of a dispute.
Harassment, threats, scams, or attempts to move transactions off-platform are strictly prohibited and may result in immediate suspension.
8. Prohibited activities
All users (buyers and sellers) may not:
- Engage in fraud, scams, or any abuse of the marketplace.
- Submit false claims, fake reviews, or manipulated disputes.
- Attempt to recover, reverse, or reclaim products after delivery.
- Bypass NightFN's checkout to avoid fees or buyer protection.
- List stolen, hacked, or otherwise illegally obtained products.
Any violation may result in order cancellation, listing removal, withheld payouts, account suspension, or permanent denial of service.
9. Third-party trademarks
NightFN is not affiliated with, endorsed by, or sponsored by any game publisher or developer. All trademarks, game titles, logos, and related assets are the property of their respective owners and are referenced solely for identification purposes.
10. Intellectual Property and User-Generated Content
Marketplace listings and their associated images, screenshots, descriptions, and other materials are submitted by independent third-party sellers. NightFN does not create or claim ownership of seller-submitted content. Sellers remain responsible for the content they submit and for ensuring that it complies with applicable intellectual property laws and does not unlawfully infringe third-party rights.
NightFN acts as a marketplace platform that hosts seller-submitted listing content. NightFN may review, restrict, disable, or remove content where appropriate, including when a valid intellectual property complaint is received.
Rights holders may report allegedly infringing content through NightFN's Copyright / IP Complaints page.
11. Limitation of service
NightFN reserves the right to:
- Refuse service, remove listings, or close accounts at its discretion.
- Cancel orders or freeze payouts where abuse or fraud is suspected.
- Modify these Terms, fees, or platform features at any time.
Continued use of NightFN after changes are published constitutes acceptance of the updated Terms.
12. Acceptance
By using NightFN as a buyer or seller, you confirm that you have read, understood, and agree to these Terms of Service together with our Refund Policy.
